THE TOWN OF TEPLICERules for providing access to information
In accordance with Act No 106/1999 Coll., on free access to information, the secretary of Teplice Town Hall has issued the following Rules for Providing Access to Information (hereinafter only “Rules”) as an internal Teplice Town Hall directive:
1. Introduction
These rules address organizational procedural matters for the realization of Act No 160/1999 Coll., on free access to information (hereinafter only the “Act”) under the conditions of the Teplice Town Hall (hereinafter only “Town Hall”). The goal of the rules is not to provide a duplicitous citation of selected provisions of the Act, but to harmonize the procedures of employees at Town Hall and town authorities during their application.
2. Releasing information (content)
As an obligated subject according to Article 2, Para. 1 of the Act the Town of Teplice (hereinafter only “Town”) is required by Article 5 to release the following information:
a) information concerning the Town as a legal entity (see Annex No. 1);
b) the organizational structure of the Town Hall (see Annex No. 2);
c.) possibilities to submit appeals against rulings by Town Hall departments and other town authorities (see Annex No. 3);
d) the method the Town Hall employs in processing requests (see Point No. 8 and Annex No. 4);
e) a summary of the most important legal regulations (see Annex No. 5);
f) a schedule of payment for the provision of information (see Point No. 9 and Annex No. 6);
g) an annual report of the provision of information for the preceding calendar year (see Point No. 10 of the Rules);
h) exclusive licenses provided pursuant to Article 14a, Para. 4;
i) resolutions of superior authorities on the amount of compensation issued according to Article 16a, Para. 7;
j) the address of electronic mailroom.
Additional information the Town releases pursuant to Article 5, Para. 4 of the Act includes valid Town legal regulations and rules, the Town budget for the relevant calendar year, plans of the Town to sell, exchange, or donate real estate, lease real estate or provide it as a loan. Other information is released according to the decisions of Town bodies and head Town Hall employees depending on their authority as defined by Act on Towns and the Town Hall organization code.
3. Method and scope of releasing information (forms)
The Town releases information in the following manners:
a) on the Town Hall notice board – generally binding Town ordinances and decrees, the Town budget, sales and leases of real estate, the commission of public orders, tenders;
b) in the daily newspaper and news media - press reports;
c) in the Town Hall information office – legal regulations available for viewing, forms and printed matter can be picked up;
d) a method enabling remote access (the Internet) – information according to Letters a) and c) as well as the official Town web site.
4. The determination of public registers
The following registers are maintained and managed at the Town Hall:
a) register of citizens
b) registry books
c) home and flat records
d) misdemeanour records
e) records of payers of local fees
f) ID card and passport records
g) motor vehicle and driver’s license records
h) trade register
This information is not accessible to all people if not subject to being publicly released pursuant to Article 5, Para. 5 of the Act.
5. The determination of accompanying information
According to Article 3, Para. 6 of the Act accompanying information is not automatically released but conveyed on the basis of a request for the provision of information.
6. Protection of information
The release and provision of certain information can be denied or restricted, though only under conditions established by the Act.
a) the protection of classified information
b) the protection of personal information
c) the protection of trade secrets
d) the protection of information regarding property relations
e) additional restrictions pursuant to Article 11
7. Sphere of internal instructions and personnel rules
Town Hall internal instructions and personnel rules are regarded, pursuant to Article 11, Para. 1, Letter a) of the Act, as information that is not subject to the requirement of being released.
8. Obligations and procedure in handling requests and the provision of information
Verbal and telephone request are handled by department heads and their representatives according to the authority established in the Teplice Town Hall Organizational Code, the Town Hall secretary, and the director of the Town Police.
Requests submitted in written form on special forms in accordance with Article 14 of the Act are recorded in the mailroom of the Town Hall Information Office and according to their nature in individual Town Hall departments and in the secretariat.
Requests can be handled in the following manners:
a) through the provision of information, written responses, or by means of a search through files (the employee creates a record of this);
b) the request is suspended if the employee is not authorized to release the requested information;
c) the request is rejected – if the request cannot be met (only in the form of a ruling issued by the head of the relevant department and containing matters pursuant to Article 15 of the Act).
9. Rate schedule
The Town releases information at its own expense. Information provided on the basis of a verbal or written request can be accompanied by payment. In the case that information will be provided in exchange for payment, the applicant must be informed in writing of the payment amount prior to the release of the information.
The department head establishes the payment amount for the provision of information according to the following rate schedule:
Wage expenses CZK 100 for each commenced hour of work by an employee involved in searching for the requested information (established on the basis of the average hourly wage for the preceding calendar year)
Material expenses CZK 2 for each photocopied page
Postage expenses The relevant postage
The applicant remits payment for the provided information at the Town Hall cash desk or by cash-free bank transfer to the Town’s bank account.
10. The compilation of the annual report
The annual report of activities in the area of the provision of information for the past calendar year in the scope pursuant to Article 18 of the Act is compiled on the basis of data from the records maintained by department heads and submitted by the organizational departments to the town council for approval so that it may be released by March 1 of the current year.
11. Access to laws
Access to regulations contained in the collection of laws, to generally binding Town ordinances and decrees, and to rules adopted by Town authorities is offered to all citizens during official hours in the Town Hall Information Office. Citizens are permitted to peruse the collection of laws at this site.
12. Final provisions
The Town secretary is responsible for coordinating procedures according to the established rules. The law and generally binding legal regulations are used to resolve matters not treated by these rules.
As of 31.12.2006 the “Rules for Providing Access to Information” issued by the Teplice Town Hall secretary on 1.10.2004 are cancelled.

The location for submitting requests and for issuing rulings (including filing appeals against rulings) is the Teplice Town Hall Information Office (Informační kancelář Magistrátu města Teplice), nám. Svobody 2. Requests and appeals against rulings are submitted on special forms available at the Town Hall Information Office or can be downloaded from our web site.
3) Appealing rulings by Town Hall departments
Appeals are filed at the Town Hall Information Office on special forms, in the period designated in the ruling, and under the conditions established in the law on whose basis the relevant ruling was issued.
Appeals cannot be filed against department measures that do not have the nature of a ruling from an administrative proceeding. Nevertheless, a special form with the specific objections can be filled out and submitted and depending on its content it will be reviewed by the town council, the mayor, or the town secretary.
4) The procedure for handling requests, motions, and other filings from citizens
Verbal and telephone request are handled by department heads and their representatives according to the authority established in the Teplice Town Hall Organizational Code, the Town Hall secretary, and the director of the Town Police.

a) through the provision of information, written responses, or by means of a search through files (the employee creates a record of this);
b) the request is suspended if the employee is not authorized to release the requested information;
c) the request is rejected – if the request cannot be met (only in the form of a ruling issued by the head of the relevant department and containing matters pursuant to Article 15 of the Act).
The term for providing the requested information is 15 days from the receipt of the request. This term can be extended by ten days for reasons of a serious nature.
